1. Acceptance of Terms

By downloading, installing, accessing, or using SplitWit (“the App”, “Website”, or “Services”), you agree to be bound by these Terms of Service. If you do not agree with all of these terms, please do not use our Services.

2. Description of Service

SplitWit is a collaborative expense-sharing application designed to help users track, split, and settle shared expenses with friends, family, and colleagues. The App provides tools for creating groups, recording expenses in multiple currencies, calculating balances, and simplifying debts.

3. User Accounts

To use SplitWit you'll need to create an account using your email, Apple ID, or Google account. You agree to provide accurate and complete information. You are responsible for maintaining the security of your credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Subscriptions and Payments (If Applicable)

While SplitWit offers core features for free, we may offer premium features through auto-renewing subscriptions (e.g., SplitWit Pro). If you purchase a subscription through the Apple App Store or Google Play Store, the sale is final, and we will not provide a refund. Your purchase will be subject to Apple's or Google's applicable payment policy, which may not provide for refunds.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any local, state, national, or international law.
  • Attempt to reverse engineer, decompile, or extract the source code of the App.
  • Interfere with or disrupt the service, servers, or networks connected to the service.
  • Share misleading, fraudulent, or defamatory expense information.
  • Use the App to harass, abuse, or harm other users.
  • Use automated scripts to collect information from or otherwise interact with the Services.

6. Intellectual Property

SplitWit and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or in any way exploit any of the content without our prior written permission.

7. Financial Disclaimer

SplitWit is strictly a tool for tracking and splitting expenses between users. It is not a financial service, bank, or payment processor. We do not process, hold, or transfer money. Any real-world settlements of debts tracked in SplitWit must be handled externally by the users.

Currency exchange rate information is provided for convenience using third-party APIs and may not reflect real-time market rates. We are not responsible for any discrepancies in conversions.

8. Limitation of Liability

To the maximum extent permitted by law, in no event shall SplitWit, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Services;
  • Any conduct or content of any third party on the Services;
  • Any content obtained from the Services, including financial calculations; and
  • Unauthorized access, use, or alteration of your transmissions or content.

9. Indemnification

You agree to defend, indemnify, and hold harmless SplitWit and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in India for the resolution of any disputes. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

11. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration rather than in court. You agree that, by entering into these Terms, you and SplitWit are each waiving the right to a trial by jury or to participate in a class action.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
